Correct - this portrait was painted in 1838, when Lee was a newly-commissioned Lt. of Engineers.
Just to clarify, John Quincy Adams was no longer President when this photo was taken, as he left office before the invention of photography. According to Wiki, this photo is from 1843 (some 14 years on); the first of any President, past or present.
