Default $65,000,000 for a pair of pants

I know this is MTSSB's department, but I couldn't help but add this one-

Would one of our members in the DC area be so kind as to track this guy down and beat the living snot out of him? Thanks in advance.

Wow, I don't know anything about the owners of the dry cleaning business. But I must say, even if they were the worst dry cleaners ever, they couldn't possibly deserve to get kicked around like that....

and then they wonder why the legal profession is held in such contempt...

can we also get James Sokolov <sp> disbarred while we are at it?

What is sad, is that it has continued for 2 years. He must have a little power to get a frivilous law suit to go on that long.

A judge should have made him take at least one of the offers, and dismissed the whole thing.

Did you miss the bit about how he IS a judge.....

Although you are still right. I was a little unclear, actually - I take it his is acting as a private plaintiff in this thing?

Ugg. Seems like there oughta be a way for them to get sanctions against the guy and force him to pay their legal fees....

    Angry

I actually posted this story on another forum earlier today.

My subject title: Some People Do Not Deserve to Live

This is completely indefensible. They actually offered him as much as $12k at one point to make the thing go away... for a pair of lost pants!!

He sounds to me like a petty, petty man who has decided to do his best to ruin this family.

He should be shunned in all decent society, but instead people comment that it is 'funny' and he actually has 65 lined up as witnesses and attempted to turn this into a class action suit against a family owned cleaners!!

He's representing himself in the case.. How's that saying go? "A lawyer who represents himself has a fool for a client"...?

I don't take things to the cleaners very often, but, if they ruined or lost something I'd be perfectly happy with getting reimbursed the cost of the article. I really do not understand what can go through someone's head to make them believe that this is an acceptable way to behave.

Imagine having to appear before this guy in court.

They offerred him 12 grand? I think the yakuza would only charge them half to make the problem go away.

This guy should be kicked off the bench and disbarred, as this is clearly a case of his using his position to intimidate the helpless.

Guess what? You wouldn't even get that. Even if you were 100% in the right, you would only receive a reduced judgement to account for the depreciation of the item.

Clearly the judge is trying to take them to the cleaners.

Well, not that it makes this better. But there is a good chance that what happened is that instead of offering to reimburse the cost, they said screw you in some form, or at least offered not much, and that pissed him off and it became about the "principle of the thing" in his clearly disproportional mind.

    I was just wondering-

If the judge feels that $65mil is just and fair for a pair of pants, what are we looking at if the tobacco industry ever appears before him?

Adds a whole new meaning to "I'm gonna sue the pants offa ya!!"
Be there or be square. Only I can do both!
I've got a cat named Beefeater and a dog named Beefeater, and two goldfish called Beefeater and Beefeater. There's Beefeater my hamster and Beefeater my horse, and my piglet, known as Beefeater of course.

He found a state law and did some math and it works out to what he is asking for. There was some stupid legislation passed to the local government could look caring--not for anyone's real good. Then we figure a law's a law and get a judge who is going to execute the letter of the law to the max without the spirit at all--and viola.

SO a cleaners has 65 unhappy customers. There may be thousands that are happy. I doubt this judge is/was/will be perfect. What we need is a law about unreasonable judges and sue him back. But what are the chances the lawyers who are the lawmakers and approvers will allow that?

I vote for summary dismissal of the claim and disbarment myself. In fact, I am finding this so upsetting that I couldn't sleep last night--can I sue back?
